Rental Fees and Payments
1. The retail value of the rented clothes will be disclosed at the time of the rental.
2. Payment of all fees is due prior to the Lessee taking possession of the clothes. Applicable taxes will be collected in accordance with state law.
Security Deposit and Payment Authorization
3. The Lessor uses Downpay via Shopify to capture and secure payment information. A $0.50 authorization fee will be charged at the time of the booking.
4. If the clothes are returned late, not returned, or returned in a condition beyond repair, the Lessor may charge the credit or debit card on file for late fees and/or the full retail value of the clothes.
5. If the payment method is declined, the Lessee remains liable for all amounts owed, and the Lessor may pursue collections.
Delivery and Returns
6. For in-store returns, the clothes must be returned by 5:00 PM on the final rental day, Monday through Saturday, or by 3:00 PM if the Return Date falls on a Sunday.
7. For shipping returns, a prepaid return label will be included with the order. The clothes must be shipped no later than the Return Date.
Care and Use of Clothes
8. The Lessee agrees to handle all rented clothes with care. The clothes shall not be altered, modified, or cleaned without the prior approval of the Lessor. Smoking while wearing the clothes is strictly prohibited.
Loss, Damage, and Theft
9. The Lessee assumes all risk of loss, theft, or damage from any cause during the rental period.
a. Minor Damages such as a broken zipper, loose hem, broken strap, or small stains will be repaired by the Lessor at no charge to the Lessee.
b. Major Damages or Total Loss, including but not limited to holes, burn marks, severe stains, or any condition rendering the clothes unwearable, will result in the Lessee being charged the full retail value of the clothes.
c. If the clothes are lost or stolen, the Lessee will be charged the full retail value of the clothes.
Late Fees
10. A late fee of $20 per day will be charged for each day when the clothes are not returned, up to the full retail value of the clothes. If the clothes are not returned within a reasonable time, the Lessee will be charged the full retail value of the clothes.
Cancellations and Refunds
11. All rentals are final sale once the clothes leave the Lessor’s possession. No cancellations, refunds, or credits will be provided.
Liability and Indemnity
12. The Lessor is not responsible for any injury, allergic reaction, or damage sustained by the Lessee arising from the use of rented clothes. The Lessee assumes all risk associated with wearing the clothes and agrees to indemnify and hold the Lessor harmless from any claims, damages, or liabilities related to such use.
Governing Law
13. This Agreement shall be governed by and construed in accordance with the laws of the State of Florida.
Entire Agreement
14. This Agreement constitutes the entire agreement between the parties and supersedes all prior discussions or agreements, whether oral or written.
